Tour Participation Terms (Draft v1.0)

TOUR / RIDE PARTICIPATION TERMS

These Terms apply to guided rides, cycling tours, supported rides and other outdoor activities operated by GS Astuto.
1. Nature of the Activity
Cycling and outdoor travel take place in real-world environments rather than controlled facilities.
Routes may use:
- public roads;
- cycleways;
- historic roads;
- rural lanes;
- gravel roads;
- paths;
- mountain roads;
- urban roads; and
- other legally accessible surfaces.
Participants should expect changing terrain, traffic, weather and local conditions.
2. Participant Ability
Participants are responsible for selecting an experience appropriate to their ability.
Descriptions of distance, elevation and difficulty are guidance rather than guarantees of how difficult an individual will find an activity.
Participants should inform GS Astuto before departure if a condition or limitation materially affects their ability to participate safely or requires a reasonable operational adjustment.
3. Guide Authority
The ride leader or responsible GS Astuto staff member may make reasonable operational decisions concerning:
- routes;
- pace;
- regrouping;
- weather;
- equipment;
- transportation;
- stopping or shortening a ride; and
- whether an individual can safely continue.
Participants must follow safety-critical instructions.
A participant whose conduct creates a material risk to themselves, other participants, staff or the public may be required to stop riding.
4. Route Changes
The advertised route is the intended route, not an unconditional guarantee.
GS Astuto may alter a route because of weather, closures, landslides, construction, traffic, participant condition, mechanical problems, natural hazards or other practical circumstances.
Where appropriate, the purpose is to preserve the overall experience rather than simply follow a predetermined line regardless of conditions.
5. Traffic and Road Law
Participants must comply with Japanese traffic law.
Instructions from a guide do not authorize a participant to disregard traffic signals, police instructions or other legal requirements.
Each rider remains responsible for observing immediate road and traffic conditions.
6. Helmets and Equipment
Helmets are required while cycling on GS Astuto operated rides.
Participants must use equipment in the manner instructed and report significant problems promptly.
7. Alcohol, Drugs and Impairment
A participant must not ride while materially impaired.
GS Astuto may prevent a participant from riding where staff reasonably believe impairment creates a significant safety concern.
8. Timing and Group Riding
Participants should arrive at the stated meeting time.
Group rides may require riders to regroup or maintain a pace appropriate to the itinerary.
A participant choosing to separate from the group without agreement may cease to receive normal guide or support services until they rejoin.
9. Weather and Natural Conditions
Activities may continue in ordinary rain, heat, cold or other conditions appropriate for the activity.
GS Astuto may modify, delay or cancel activities where conditions create an unacceptable operational risk.
Japan is subject to earthquakes, typhoons, heavy rainfall, landslides, extreme heat and other natural events. Instructions issued by public authorities take priority over the planned itinerary. Cancellation of Rental and / or Tour may be made if JMA Level 3 or higher Alert or warning. JMA Level 2 will be solely up to the guide's or owner's discretion.
10. Personal Equipment and Clothing
Participants are responsible for bringing suitable clothing and personal equipment identified in the booking information.
Recommendations may change according to season and forecast conditions.
11. Medical Assistance
GS Astuto staff may provide reasonable first response within their training and equipment.
Serious medical assessment and treatment remain the responsibility of qualified medical services.
Where circumstances reasonably require emergency medical assistance, GS Astuto may contact emergency services on behalf of a participant.
12. Inherent Risk
Participants acknowledge that cycling and outdoor activities can involve falls, collisions, traffic incidents, physical exertion, exposure to weather and other hazards that cannot be entirely eliminated.
Participation constitutes acceptance of the ordinary and inherent risks of the activity.
13. Liability
Nothing in these Terms excludes liability that cannot legally be excluded.
Participants remain responsible for consequences arising from their own unlawful or materially reckless conduct to the extent provided by law.
14. Travel and Medical Insurance
Participants should maintain travel and medical insurance suitable for their circumstances and planned activities.
Customers remain responsible for medical expenses, repatriation expenses and other personal costs except where GS Astuto is legally responsible for those costs.
15. Minors
Participation by a minor requires prior acceptance by GS Astuto and consent from a parent or legal guardian.
Additional conditions may apply depending on the activity.
16. Photography
Participation in a tour does not by itself grant GS Astuto unrestricted permission to use identifiable photographs of a participant for advertising.
Where specific promotional consent is required, it should be obtained separately.
17. Acceptance
Booking and participating in an applicable activity constitutes acceptance of these Terms.
