Bicycle Rental Agreement & Liability Waiver (Draft v1.0)

Important: Draft intended for review by qualified Japanese legal counsel. This Agreement forms part of the GS Astuto Terms of Service.

1. Scope

This Agreement applies to every bicycle, e-bike, helmet, accessory and related equipment rented or loaned by GS Astuto.

2. Rider Eligibility

  • are legally capable of entering this Agreement or are accompanied by a parent or guardian;
  • are physically capable of safely operating the rented bicycle;
  • will immediately disclose any medical condition that could materially affect safe participation;
  • will not ride while impaired by alcohol, drugs or medication affecting judgement.

3. Safety Requirements

  • obey all applicable Japanese laws;
  • wear a properly fitted helmet whenever riding;
  • follow instructions provided by GS Astuto staff;
  • ride within their own ability;
  • stop riding immediately if the bicycle appears unsafe.

4. Bicycle Care

  • take reasonable care of the bicycle;
  • use an approved lock whenever leaving the bicycle unattended;
  • protect the bicycle from theft and unnecessary damage;
  • avoid unauthorised repairs or modifications;
  • return all supplied equipment.

5. Permitted Use

Unless specifically authorised in writing, bicycles shall not be raced, used for commercial delivery, ridden by anyone other than the named renter, transported on unsuitable vehicle racks, or intentionally ridden on terrain beyond their intended purpose.

6. Mechanical Issues

  1. Stop riding if safety is affected.
  2. Contact GS Astuto as soon as reasonably possible.
  3. Do not attempt major repairs without approval except where necessary for immediate safety.

7. Damage

The renter is responsible for damage beyond ordinary wear and tear, including crash damage, bent wheels, broken carbon components, damaged drivetrains, lost accessories, and negligent transport or storage.

8. Theft or Loss

Notify GS Astuto immediately, report the theft to police where appropriate, and cooperate with any insurance claim. Failure to take reasonable precautions may result in financial responsibility.

9. Security Authorization

GS Astuto may place a pre-authorisation hold on the renter's credit card. This is not a charge unless converted under this Agreement.

Accidents, assumption of risk, release of liability, indemnity, medical consent, insurance, governing law (Japan), electronic acceptance, and entire agreement clauses apply as stated in the GS Astuto legal suite.
